First, the 2nd Circuit Court of Appeals declared that the FCC’s indecency rule, which was put into place after the infamous Janet Jackson nipple fiasco, is unconstitutionally vague. Then, E!’s Marc Malkin, clearly feeling emboldened by the court’s decision, exercised his first amendment rights by posing the question: “How Will Mel Gibson’s Latest Rants Affect Jodie Foster’s Beaver?”
